New Fire and Carbon Monoxide Regulations — How to Comply

New laws came into force on the 1st October 2015 that make it a legal requirement for landlords to ensure tenant safety from fire and poisoning by carbon monoxide. The new legislation seeks to cut the alarming number of injuries and deaths suffered by tenants due to landlords failing to install smoke and carbon monoxide detectors.

The new regulations state that landlords must:

  • Install a smoke alarm on every single floor of their property

  • Install a carbon monoxide alarm in any room containing a solid fuel stove or other such appliance

  • Check and maintain all alarms at the start of every new tenancy and inform new tenants of the location and usage instructions for all alarms and detectors

  • Immediately replace any faulty or malfunctioning alarms upon notification from the tenant

Making sure that these regulations are strictly enforced will be the responsibility of the local housing authority and can arrange for alarms to be fitted at the landlord’s expense should that landlord fail to do so themselves. This would incur a penalty charge to the landlord of £5,000. All specified tenancies - defined as residential premises on which rent is payable - will fall under the new regulations and further guidance will be provided by the Government covering factors such as testing and how the law interacts with the Regulatory Reform (Fire Safety) Order.
